SECTION 1: “The Forkies ” PROMOTION

TERMS AND CONDITIONS

  1. The Forkies (“Promotion”) is conducted by Moreton Bay Region Industry & Tourism (MBRIT) ABN 91 604 740936 of 55 Miller Street, Kippa-Ring, Queensland, 4020, phone (07) 3897 499, (“Promoter”).
  2. Entry into the Promotion constitutes acceptance of these terms and conditions. All entry instructions and prize information published by the Promoter form part of these terms and conditions.
  3. Entry is only open to businesses with a permanent address (bricks and mortar) that sell either food or drinks, as part of their core business, in the Moreton Bay Region. In this promotion, Moreton Bay Region is defined as being an establishment that serves food and drinks (both takeaway and eat-in) and other hot and cold beverages along with breakfast, lunch, dinner and other snack food items (Entrants) within the boundaries of the Moreton Bay Regional Council catchment area.
  4. Nominations open at 9:00am AEDST on 17 May 2019 and nominations close at 5:00pm AEDST on 13 June 2019 (Nomination Period). All times and dates throughout these Terms and Conditions are based on Brisbane, Australia local time.
  5. To enter the Promotion, Nominee or authorised representatives aged 18 years or over (on behalf of Nominee) must, during the Promotional Period undertake the following steps:
    1. Visit www.theforkies.com.au
    2. Follow the prompts to the registration component of the website; and
    3. Provide all requested information to enter
  6. The Promoter may reject an Entry if it reasonably forms the opinion that the Entry has been entered using false information or via automated entry means or by use of a competition entry service.
  7. The Promoter may, at its absolute discretion, declare an Entry made by an Entrant invalid if the Entrant tampers with the entry process, benefits from such tampering or submits an Entry that is illegible, incomplete or not in accordance with these terms and conditions.
  8. The Promoter may (subject to State Regulations) vary the terms of, or terminate, this Promotion at any time at its absolute discretion without liability to any entrant, contestant or other person. The Promoter will not award the prize if the Promotion is terminated for whatever reason.
  9. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, communication network, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise preventing entrants from successfully submitting an Entry, any injury or damage to entries or to participants’ or any other person’s computer related to or resulting from participation in or downloading any materials in this Promotion.
  10. Limit of one (1) entry per nominee, per category.
  11. Only registered nominees are able to display promotional materials.
  12. No Nominee may offer a prize, discount or any other inducement/benefit to gain votes. If the Promoter discovers this has occurred, then the Promoter may invalidate the nominee from the Promotion in its absolute discretion.
  13. All individuals acknowledge and understand the Promotion does not include all Moreton Bay Region businesses. Accordingly, being a winner of the Promotion does not mean that a given business is indeed the best business in the Moreton Bay Region.
  14. All nominations must be received by the Promoter during the Nomination Period. Entries received before the start of the Promotional Period or after the close of the Promotional Period will be deemed invalid and will not be eligible to win any prize. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
  15. The Promoter reserves the right, at any time, to verify the validity of entries and Nominees (including a Nominees identity, and place of business) and reserves the right, in its sole discretion, to disqualify any Nominee who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  16. Entries must be received during the Entry Period. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment.
  17. If there is a dispute as to the identity of a Nominee the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
  18. Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.
  19. There is no cost to enter the Promotion; however, internet connection and usage rates may apply. Entrants should obtain details of such costs from their service providers. The Promoter is not and will not be liable for any such costs.

PRIZES AND DETERMINATION OF WINNERS

  1. There will be 11 category prizes awarded in the Promotion, one (1) to each of the Entrants that receives the most votes in their category in the competition during the Voting Period, subject to any limitations as set out in these Terms and Conditions.
  2. The details of the prize are outlined below:
    1. $500 advertising package on Visit Moreton Bay Region
    2. 2 x Tickets to the Business Moreton Bay Region Interactive Lunch Series (August edition)
  3. Prize values and conditions:
    1. Visit Moreton Bay Region advertising package valued at $500
    2. 2 x Tickets to Business Moreton Bay Region Interactive Lunch Series valued at $178.00
  4. There will be one (1) major prize awarded in the Promotion the Entrant that receives the most votes overall in the competition during the Voting Period, subject to any limitations as set out in these Terms and Conditions.
  5. The details of the prize are outlined below:
    1. $1,000 cash
    2. $5,000 Quest Community News print advertising package
    3. $2,000 Bishopp Outdoor Advertising package
    4. $2,000 Code Artists digital marketing package
    5. $5,000 Visit Moreton Bay Region advertising package
  6. Prize values and conditions:
    1. $1,000 cash will be paid out by way of a payment to the winning Entrants’ business bank account.
    2. Quest Community News print advertising package valued at $5,000
      1. Individual prize value is up to $5,000 (including GST). One winner will receive:
  1. 1 x $5,000 print advertising campaign in Quest Community News publications;
  2. To be run in addition with the winners existing or new paid advertising campaign up until 30 June 2020;
  3. This $5,000 worth of print advertising is at rate card value and NOT the winners contracted discount rate (if a current client);
  4. This $5,000 can be used for any type of print advertising within a Quest Community News publication, i.e. wraps, creative shapes and placement within the paper;
  5. The prize cannot be transferred, exchanged or redeemed for cash and can only be used to promote the goods and services of the prize winner;
  6. If the winners business ceases operating, the prize cannot be transferred, exchanged or redeemed for cash;
      1. The $5,000 print advertising campaign will be agreed upon and managed by relevant account Sales Manager or Account Executive. For current customers, this will be done to ensure the $5,000 in print advertising is used in addition to an already existing campaign and not instead of it.
      2. Quest Community News publications, as at the commencement of this competition, are the following: Albert & Logan News, Bribie Weekly, Caboolture Herald, Northside Chronicle/Bayside Star, North-West News, Pine Rivers Press, Redcliffe & Bayside Herald, South-East Advertiser, Southern Star, South-West Satellite, Westside News, and Wynnum Herald.
    1. Bishopp Outdoor Advertising package valued at $2,000
      1. Individual prize value is up to $2,000 (including GST). One winner will receive:
  1. 1 x $2,000 outdoor advertising campaign on Bishopp outdoor advertising;
  2. To be run in addition with the winners existing or new paid advertising campaign up until 30 June 2020;
  3. This $2,000 worth of outdoor advertising is at rate card value and NOT the winners contracted discount rate (if a current client);
  4. Prize does not include printing or installation;
  5. This $2,000 can be used for any type of outdoor advertising within a Bishopp Outdoor Advertising billboard;
  6. The prize cannot be transferred, exchanged or redeemed for cash and can only be used to promote the goods and services of the prize winner;
  7. If the winners business ceases operating, the prize cannot be transferred, exchanged or redeemed for cash;
    1. Code Artists digital marketing package valued at $2,000
      1. Individual prize value is up to $2,000 (including GST). One winner will receive:
  1. 1 x $2,000 Code Artist digital marketing package;
  2. To be run in addition with the winners existing or new paid advertising campaign up until 30 June 2020;
  3. This $2,000 worth of digital marketing is at rate card value and NOT the winners contracted discount rate (if a current client);
  4. This $2,000 can be used for any type of digital marketing with Code Artist;
  5. The prize cannot be transferred, exchanged or redeemed for cash and can only be used to promote the goods and services of the prize winner;
  6. If the winners business ceases operating, the prize cannot be transferred, exchanged or redeemed for cash;
      1. The $2,000 digital marketing package will be agreed upon and managed by relevant account Sales Manager or Account Executive. For current customers, this will be done to ensure the $2,000 digital marketing package is used in addition to an already existing campaign and not instead of it.
    1. Visit Moreton Bay Region digital marketing package valued at $5,000
      1. Individual prize value is up to $5,000 (including GST). One winner will receive:
  1. 1 x $5,000 Visit Moreton Bay Region digital marketing package;
  2. To be run in addition with the winners existing or new paid advertising campaign up until 30 June 2020;
  3. This $5,000 worth of digital marketing is at rate card value and NOT the winners contracted discount rate (if a current client);
  4. This $5,000 can be used for any type of digital marketing with Visit Moreton Bay Region;
  5. The prize cannot be transferred, exchanged or redeemed for cash and can only be used to promote the goods and services of the prize winner;
  6. If the winners business ceases operating, the prize cannot be transferred, exchanged or redeemed for cash;
      1. The $5,000 digital marketing package will be agreed upon and managed by relevant account Sales Manager or Account Executive. For current customers, this will be done to ensure the $5,000 digital marketing package is used in addition to an already existing campaign and not instead of it.
  1. The $2,000 outdoor advertising campaign will be agreed upon and managed by relevant account Sales Manager or Account Executive. For current customers, this will be done to ensure the $2,000 in outdoor advertising is used in addition to an already existing campaign and not instead of it.
  2. Unless otherwise expressly stated, prize values are based upon the recommended retail prices at the time of first publication of these Terms and Conditions (inclusive of GST).
  3. Prizes cannot be transferred, exchanged or redeemed for cash.
  4. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
  5. Prize must be taken before Tuesday 30 June 2020. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
  6. If there is tie between two or more Entrants for a prize, each of those tied individuals will be sent a tie-breaker question of why they deserve the prize, with the Entrant that sends the best answer in the required time in 25 words or less (based on literary and creative merit) awarded the prize.
  7. The winners of the minor prizes will be notified in writing by email.
  8. The major prize winner and region prize winners will be published online at www.theforkies.com.au; and as well as on The Forkies Facebook and Instagram accounts on 2 August 2019 at 9.00AM AEST.

SECTION 2: “THE FORKIES VOTING” PROMOTION 2019

  1. Information on how to enter The Forkies Voting Promotion 2019 (Promotion) and the prizes form part of these Terms and Conditions. By participating, Entrants (as defined below) agree to be bound by these Terms and Conditions.
  2. Entry is only open to Australian residents (Entrants).
  3. The Promotion commences at 9:00am AEST on 14 June 2019 and entries close at 5:00pm AEST on 22 July 2019 (Promotional Period).
  4. The winner will be drawn on 2 August 2019 at 9.00AM AEST.
  5. The Prize winner will be notified immediately via phone or email. The name of the prize winner will be published atwww.theforkies.com.au on 2 August 2019 for a period of not less than 7 days.
  6. To enter the Promotion, Entrants must, during the Promotional Period undertake the following steps:
    1. visit www.theforkies.com.au;
    2. follow the prompts to the voting component of the website;
    3. provide all requested personal information; and
    4. in accordance with the directions submit a vote for their favourite venues from those venues listed on the website.
  7. By submitting a vote the Entrant will receive one (1) entry in the draw. Limit of one (1) vote (and accordingly one (1) entry) per Entrant with a valid email address. Votes from invalid email addresses will be null and void.
  8. All entries must be received by the Promoter during the Promotional Period. Entries received before the start of the Promotional Period or after the close of the Promotional Period will be deemed invalid and will not be eligible to win any prize. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
  9. Entrants can only enter in their own name and not on behalf of another individual. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age, place of residence and email address) and reserves the right, in its sole discretion, to disqualify any Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Any Entrant in breach may be denied entry to any future promotions held by the Promoter. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  13. VIP pass cannot be transferred, exchanged or redeemed for cash.
  14. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
  15. The Promoter may (subject to State Regulations) vary the terms of, or terminate, this Promotion at any time at its absolute discretion without liability to any entrant, contestant or other person. The Promoter will not award the prize if the Promotion is terminated for whatever reason.

  17. The Prize notification will state that the Prize has been won and will include instructions as to how the Winner may claim the Prize and establish his/her entitlement to it. The Winner must be able to prove to the Promoter’s satisfaction, that he/she satisfies the requirements of being an Entrant pursuant to condition these Terms and Conditions.
  18. Should the prize not be claimed by 12pm 21/08/2019, the Promoter may conduct an unclaimed prize draw at 1:00pm AEST at Moreton Bay Region Industry and Tourism office at 55 Miller Street, Kippa-Ring QLD 4021.

GENERAL

  1. The total prize pool is $26,500 inc GST
  2. Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.
  3. The Promoter’s decision in all matters relating to this Promotion is final and no correspondence will be entered into.
  4. If a prize (or an element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that element of the prize) with another prize of equal value and/or specification, subject to any written directions from a regulatory authority.
  5. If for any reason a winner does not use, redeem or take a prize (or an element of a prize) by or at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
  6. Entrants who win a prize consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media, for an unlimited period and without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  7. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
  8. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non- Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  9. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
  10. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
  11. Any theft, unauthorised access or third party interference;
  12. Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  13. Any variation in Prize value to that stated in these Terms and Conditions;
  14. Any tax liability incurred by a winner or Entrant; or use, redemption or taking of a prize.
  15. As a condition of accepting a prize, each prize winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  16. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on individuals providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its privacy policy, which can be viewed at MBRIT’s website, www.mbrit.com.au (Privacy Policy). In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the individual. The Privacy Policy also contains information about how individuals may opt out, access, update or correct their personal information, how individuals may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose personal information overseas. All entries become the property of the Promoter.
